15-REA-14 Christopher J. Actie (#02-28943) Civil Penalty of $2,000 and Ordered to complete a 15-hour National USPAP Course for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”) Art., Annotated Code of Maryland, §§16-309 and COMAR 09.19.02.04 by failing to demonstrate compliance with a continuing education audit.

14-REA-46 Scott Cuthbert (#03-28682) Ordered to complete a 15-hour Residential Appraiser Site Valuation and Cost Approach course for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”), §16-701(a)(1)(x)(xi)(xii)&(xiii) and Uniform Standards of Professional Appraisal Practice (“USPAP”) Standards Rules 1-3(a), 1-3(b), 1-1(b) and 2 by failing to exercise reasonable diligence to develop, prepare or communicate an appraisal; and being negligent or incompetent in developing, preparing or communicating an appraisal.

16-REA-07 Yevgeny Gekht (#03-28097) Civil Penalty of $5,000 and Ordered to complete a 15-hour National USPAP Course for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”), §16-701(a)(1)(x)(xi)(xii)&(xiii) and Uniform Standards of Professional Appraisal Practice (“USPAP”) Standards Rules 2-3, 2-2(a)(xii) and the Conduct Section of the Ethics Rule by failing to exercise reasonable diligence to develop, prepare or communicate several appraisals; and being negligent or incompetent in developing, preparing or communicating an appraisal.

Gregory (#03-12124) Ordered to complete a 15-hour National USPAP Course, a Basic Appraisal Principles Course (30 hours), and a Basic Appraisal Procedures Course (30 hours) for violating Md. Code Ann., Bus. Occ. & Prof. Art. Hoover, II (#03-29541) Civil Penalty of $1,500 and Ordered to complete a Residential Sales Comparison and Income Approaches course (30 hours) and an Advanced Residential Applications and Case Study course (15 hours) for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”), §16-701(a)(1)(x)(xi)(xii)&(xiii) and Uniform Standards of Professional Appraisal Practice (“USPAP”) Standards Rules 1-1(a), 1-1(b), 1-4(a), 1-6(a), 2-1(a), 2-1(b) and the Record Keeping and Conduct Section of the Ethics Rule and the Scope of Work Rule by failing to exercise reasonable diligence to develop, prepare or communicate an appraisal; and being negligent or incompetent in developing, preparing or communicating an appraisal.

15-REA-15 John G. Meiser (#03-12783) Civil Penalty of $1,000 and ordered to complete a 15-hour National USPAP Course and a 30-hour Residential Sales Comparison and Income Approaches Course for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”), §16-701(a)(1)(x)(xi)(xii)&(xiii) and Uniform Standards of Professional Appraisal Practice (“USPAP”) Standards Rules 1-4(a), 1-6(a), 2-1(b), 2-1(c), 2-2(a)(viii), 2-2(a)(xi), 1-2(f), the Record Keeping Rule, Scope of Work Rule, and the Conduct Section of the Ethics Rule by failing to exercise reasonable diligence to develop, prepare or communicate an appraisal; and being negligent or incompetent in developing, preparing or communicating an appraisal.

15-REA-21 Joseph Michael Moran (#04-7538) Civil Penalty of $500 for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”), §16-511 and COMAR 09.19.02.04 by renewing his license with 35 of the required 42 hours of continuing education complete, with the remaining 7 hours being completed subsequent to the renewal.

Payne-Jones (#03-4716) Civil Penalty of $1,500 and Ordered to complete a Basic Appraisal Procedures Course (30 hours) and a Residential Report Writing and Case Studies Course (15 hours) for violating Md. Code Ann., Bus. Occ. & Prof. Art. (“BOP”), §16-701(a)(1)(x)(xi)(xii)&(xiii) and Uniform Standards of Professional Appraisal Practice (“USPAP”) Standards Rules 1-1(a), 1-1(b), 1-1(c), 1-2(e), 1-4(a), 1-4(b), 1-6(a), 2-1(a), 2-1(b), 2-2(b)(iii), 2-2(b)(xi), the Record Keeping Rule and the Ethics Rule by failing to exercise reasonable diligence to develop, prepare or communicate an appraisal; and being negligent or incompetent in developing, preparing or communicating an appraisal.

HOME INSPECTORS

15-INSP-09 Alfred Brumbley, (#30461) fined $2,000 for violating BOP Art., Annotated Code of Md., §§16-3A-01(a), 16-703.1, and 16-705.1 by performing home inspection services in Maryland without a license and for misrepresenting to the public that he was authorized to perform home inspection services when he was not licensed.

15-INSP-03 Gordon Dawson, Sr., (#30064) fined $100 for violating BOP Art., Annotated Code of Md., §§16-3A-01(a), 16-701.1(a)(6) by performing home inspection services in Maryland during a lapse in licensure.

14-INSP-07 William Horne (#29949) Revoked, fined $5,000, and not eligible for reinstatement of his license for at least five (5) years from his revocation for violating BOP Art., Annotated Code of Md., §§16-4A-01(a)(2) and (4), 16-701.1(a)(3), (6) and (7), 16-701.1(b)(1), and COMAR 09.36.04.02.A, 09.36.07.02D(2)(a) and (b), 09.36.07.04A and C(1)-(5), 09.36.07.05A(1)-(6) and B, 09.36.07.06A(1)-(4) and B, 09.36.07.07A(1)-(8) and B(1)-(3), 09.36.07.08A(1)-(10) and B(1) and (2), 09.36.07.09B, 09.36.07.10B, 09.36.07.11A(1)-(5), 09.36.07.12A(1)-(3) and B(1) and (2), and 09.36.07.13B(1)by performing home inspection services in which he failed to identify substantial structural defects, failed to inspect required areas that he claimed to have inspected, and failed to observe and report numerous deficiencies, by failing to meet numerous provisions of the Minimum Standards of Practice governing home inspectors, by failing to include statutorily-mandated disclosures, and by performing home inspection services incompetently and negligently.

15-INSP-07 William Horne (#29949) Revoked for violating BOP Art., Annotated Code of Md., §§16-4A-01(a)(2) and (4), 16-701.1(a)(3), (6) and (7), 16-701.1(b)(1), and COMAR 09.36.04.02.A, 09.36.07.02D(2)(a) and (b), 09.36.07.04A and C(1)-(5), 09.36.07.05A(1)-(6) and B, 09.36.07.06A(1)-(4) and B, 09.36.07.07A(1)-(8) and B(1)-(3), 09.36.07.08A(1)-(10) and B(1) and (2), 09.36.07.09B, 09.36.07.10B, 09.36.07.11A(1)-(5), 09.36.07.12A(1)-(3) and B(1) and (2), and 09.36.07.13B(1) and (2).

15-INSP-12 Andrew Renaux (none) fined $500 for violating BOP Art., Annotated Code of Md., §§16-3A-01(a) by performing home inspection services in Maryland without a license.

14-INSP-11 Robert Lee Wootten (#29566) fined $250 for violating BOP Art., Annotated Code of Md., §16-701.1(a)(7) and COMAR 09.36.04.02A for failure to respond in writing within 30 days of receipt of a written communication from the Commission.
